    Well, they didn't want to be perceived as greedy. lol.

    I'm thinking there's a major piece of information we don't have. It was mentioned that their friends threatened the repossession people. You start to wonder if this was one of those cases of letting someone else take over payments and not with the permission of the bank. None of it makes sense but then theft generally doesn't.

    Also, no one says how long after it was taken before it was noticed, but seems like a few days as it didn't hit the newspaper until days after the theft.

    Couple further comments. My points here are:
    1. No-one here can know the story.
    2. The boat may or may not have not been stolen.
    3. People need to understand the law in there jurisdiction
    4. With long range moveable property multiple jurisdictions may be in play.
    5. People generally assume too much.
    6. Simple financial transactions are not commonly understood by those making them.
    7. Cleaver people can do many things to create ignorant and innocents big problems.

    I can say many of the comments show a basic lack of understanding of law. I too used to be ignorant and paid a lot of dues for that failing.

    Everyone here (I am speaking to those mostly in the USA) that borrows money or buys things that could have liens on them needs to read and have a basic understand Article 3 and Article 9 of the UCC as adopted by their State of residence. As well as understand other fundamental aspects of law that hugely effects their lives. Such as the Statue of Frauds (that is not what you may think... it simply about what types of agreements must be in writing and what does not). These are basic necessities for existence in the modern world.

    Boaters need to also know and have a general understanding of law as to maritime laws, Coast Guard Regulations, Custom laws, Department of State Regulations including those on money movements between countries or entry and leaving USA, Drug laws, tax law and even employment law if they have employees helping out on the boat. In Europe the EURO ZONE was suppose to make these type of things consistent and promote easy movement and constancy between various countries it has not... and many countries violate the terms of that. Florida and the SE USA are particularly in peril due to the near by latin America and Islands of the Caribbean... which can have wildly varying law applying.

    If you don't you are laying yourself open to problems. I suggest reading my Thread on "How do you know if the boat has a lien on it". Partly is is about the asset protection methods used to protect substantial property... and the dangers the liens create for a down stream buyer. FYI using debt instruments and derivatives are very good for asset protection. Because of that and the fact people can borrow money on yachts there are dangers for a buyer knowing if he is buying trouble rather than recreational enjoyment. In that thread, I relate a personal story of a small sailboat I bought in the USA long time ago and ended up responsible for an excavating companies debts... which had been paid... and how this cost me more than three new boats. In the USA many judges and people figure the bank is official honest and always right, and many judges are as ignorant as the common man on many aspects of financial law. That thinking lead to the 2008 financial meltdown.

    I can say in Europe I will not ever buy a boat in Italy or Spain... I will in Germany, Holland, France and England... the rest is a crap shoot... I might say I am not too fond of the Dutch but that is a personal choice. The Channel Islands and Isle of Mann are special places and may seem to have British law but are both special cases of Royal Holdings, and law is not the same as in Britain proper. In France it is pretty straight forward and safe but there are still pitfalls but they are easy to avoid. Monaco is pretty good but operating your boat out of there can be very expensive due to social requirements and taxes the Prince imposes... and you may be asked to leave for the GP so the Prince can rent the space for large amounts of money for the GP, and they like to impose large fines for slight transgressions... don't get a traffic ticket there. I suppose the worse part about France is everything is in French and they have a different mind set than in other places there minds work different... marry a French girl and you will find out it don't translate quite often. One might think the Swiss would be very safe... well that is the case if you are Swiss but may not if you are not.

    Not if you want something to move lots of drugs or people that has a long range, you then steal a trawler.

    So you are going to now insult anyone who doesn't agree with you or jump on your bandwagon? I understand quite a bit, obviously more than you as I've never put myself in the situation to have to "pay a lot of dues." I use attorneys to avoid trouble, not to litigate or deal with it.

    And frankly I'm tired of your insults of the intelligence of those in the US. (in fairness you do speak ill of many other countries as well..)

    Actually 12 Days later. It was taken at 1:25 AM on the 12th. Actually work started around 8:30 on the 11th.

    I am no expert in that rotten line of work but it seems to me that considering the money involved in "moving large amount of drugs" buying a cheap used trawler would be nothing compare to having to worry about using a stolen boat.

    The article first appeared late on the 17th. So when do we think they first realized it was missing? That would have been a 5 day head start at that point. 1200 nm in five days? How many countries are within 1200 miles of Dania? 2 within 100 nm. Maybe 15 within 500. Over 25 within 1200 miles.

    Wouldn't it be funny if the marina in question had simply relocated the vessel and someone jumped the gun on the whole " stolen boat " scenario ?
    When the article said a yard hand had helped out on obsconding the vessel, when actually he was just following orders.
    It's not too far fetched to think the news media MIGHT get it all, entirely, wrong.

    Five hours of video, boat pulling out, boat located elsewhere....pretty well refutes that possibility.

    This happened at our marina a fe months ago... A 40ish express was thought to be stolen, a few days later it turned out a mechanic had just picked it up to do some work on it... Owner / captain / mechanic miscommunication!

    Erraaahh
    We have to pick and deliver at all hours. 0130 is not to bad of a time.
    The Ortega river does not offer much at the mud delta. Some of our customers draw 6 feet.
    If it takes a 0130 or 0530 tide to get in or out, were there.
    Also, just for first haul in the morning at the local service marina travel lifts, we again move boats at odd hours.
    Some post above stated local yard hand was helping, nobody who saw anything would question it.
    That's understood.
    When heads do pop up on us @ 0300,,"Oh, it's just you guys" and goes back to sleep.

    I think the theory was that there was come collusion involving a local yard hand. I guess the reality is they claim 24/7 security, so either there's some collusion or people just aren't doing their job.
